property line issues

Well, once again we're having property line issues with our neighbor. Back, when we purchased the lot, we noticed that our left neighbor was encroaching about 25-30 ft. We had them sign an affidavit, remove a birdhouse and a newly planted tree, before purchasing. I was hoping that was the end of it........ I was mistaken.

About a week ago, the utilities came out and flagged off where the underground utilities are, so they were marked for when the septic would be installed. Yesterday I noticed that the same area had been mowed and not only the utility flags had been removed, but also the darn property marker stake as well.

Since no one at Barden, nor us had removed them, we're guessing that our neighbor removed them to mow. The kicker is that it's not even their property to take care of. We're trying to give them the benefit of the doubt that they just don't know any better to not touch utility and property markers. We're all a bit perturbed though, cause now the utilities have to come back and flag out everything again.

I was advised by Barden to stake out my property, bluntly, so that the property lines aren't confused anymore. So that's what I had done this morning. I pounded in 5 rebar stakes and stringed them with florescent, contractors grade, nylon string. It extended all the way from the front to the back, including right over their flower bed that encroaches over the property line by 2.6 feet. Hopefully, that's all we'll need to do to get the point across.
